End User License Agreement (EULA)

Effective Date: July 15, 2026

This End User License Agreement (“Agreement” or “EULA”) is a legal agreement between you (“User,” “you,” or “your”) and Permanent Lighting Experts LLC (“Permanent Lighting Experts,” “PLE,” “we,” “our,” or “us”) governing your use of the PLE mobile application (“App”), including all software, updates, documentation, and related services provided through the App.

By downloading, installing, or using the App, you agree to be bound by this Agreement.

If you do not agree to these terms, do not install or use the App.

1. License Grant

Subject to your compliance with this Agreement, Permanent Lighting Experts LLC grants you a limited, revocable, non-exclusive, non-transferable, non-sublicensable license to:

  • Download the App
  • Install the App
  • Access the App
  • Use the App on devices you own or control

solely for your personal or authorized business use.

This license does not transfer ownership of the App or any intellectual property.

2. Ownership

The App, including all:

  • Software
  • Source code
  • Databases
  • Designs
  • Graphics
  • Icons
  • Logos
  • Text
  • Documentation
  • Updates
  • Features
  • Trademarks

remain the exclusive property of Permanent Lighting Experts LLC and its licensors.

This Agreement grants only a license to use the App and does not grant ownership of any intellectual property.

3. License Restrictions

You may not:

  • Copy the App except as permitted by applicable law
  • Modify the App
  • Adapt the App
  • Translate the App
  • Reverse engineer the App
  • Decompile the App
  • Disassemble the App
  • Attempt to discover source code
  • Remove copyright notices
  • Remove trademarks
  • Circumvent security measures
  • Create derivative works
  • Sell the App
  • Lease the App
  • Rent the App
  • Sublicense the App
  • Distribute unauthorized copies
  • Use the App for unlawful purposes

Any unauthorized use immediately terminates this license.

4. Updates

Permanent Lighting Experts LLC may release:

  • Software updates
  • Security patches
  • Bug fixes
  • New features
  • Performance improvements

Some updates may be required for continued use of certain features.

Failure to install updates may reduce functionality or prevent access to portions of the App.

5. Internet Connectivity

Certain App features require:

  • Internet access
  • Cloud connectivity
  • Authentication services
  • Push notification services

Your mobile carrier or internet provider may charge fees for data usage.

You are responsible for any charges associated with your device or internet connection.

6. Third-Party Services

The App integrates with third-party services including, but not limited to:

  • Supabase
  • Amazon Web Services (AWS)
  • Stripe
  • Twilio
  • Apple Sign In
  • Google Sign-In
  • Apple Push Notification Service (APNs)
  • Google Firebase Cloud Messaging (FCM)

Your use of those services may also be governed by their respective terms and privacy policies.

Permanent Lighting Experts LLC is not responsible for the availability or performance of third-party services.

7. User Accounts

Certain features require an authenticated account.

You are responsible for:

  • Maintaining the confidentiality of your credentials
  • Restricting access to your account
  • All activity occurring under your account

You agree to notify us promptly if you suspect unauthorized access.

8. User Content

The App allows users to upload information including:

  • Installation records
  • Warranty documentation
  • Project photos
  • Notes
  • Customer information
  • Profile images
  • Other project-related files

You retain ownership of the content you upload.

You grant Permanent Lighting Experts LLC a limited, worldwide, non-exclusive license to host, store, process, display, and transmit your content solely for the operation, maintenance, improvement, and support of the App and related services.

9. Intellectual Property

All copyrights, patents, trademarks, trade secrets, software, designs, and other intellectual property associated with the App remain the exclusive property of Permanent Lighting Experts LLC.

Nothing contained in this Agreement grants you ownership of any intellectual property.

10. Privacy

Your use of the App is also governed by the PLE Privacy Policy.

By using the App, you acknowledge that you have reviewed and accepted the Privacy Policy.

11. Termination

This license remains effective until terminated.

Permanent Lighting Experts LLC may suspend or terminate your license immediately if:

  • You violate this Agreement
  • You misuse the App
  • You engage in fraudulent activity
  • You compromise the security of the App
  • Continued access poses a risk to the App or its users

Upon termination, you must stop using the App and delete all copies in your possession.

12. Disclaimer

The App is provided “AS IS” and “AS AVAILABLE.”

To the fullest extent permitted by law, Permanent Lighting Experts LLC disclaims all express and implied warranties, including warranties of:

  • Merchantability
  • Fitness for a particular purpose
  • Non-infringement
  • Continuous availability
  • Error-free operation

We do not guarantee that the App will operate without interruption or that defects will be corrected immediately.

13. Limitation of Liability

To the fullest extent permitted by law, Permanent Lighting Experts LLC shall not be liable for any indirect, incidental, consequential, special, exemplary, or punitive damages arising from or related to your use of the App.

Our total liability for any claim arising from this Agreement shall not exceed the amount paid directly to Permanent Lighting Experts LLC for use of the App during the twelve (12) months preceding the claim.

14. Export Compliance

You agree to comply with all applicable United States export control laws and regulations when downloading or using the App.

You may not use or export the App where prohibited by applicable law.

15. Governing Law

This Agreement shall be governed by the laws of the State of Utah without regard to conflict of law principles.

Any disputes arising under this Agreement shall be resolved exclusively in the state or federal courts located in Utah.

16. Apple App Store Additional Terms

If you downloaded the App from Apple’s App Store, the following additional terms apply:

  • This Agreement is between you and Permanent Lighting Experts LLC, not Apple Inc.
  • Apple is not responsible for the App or its content.
  • Apple has no obligation to provide maintenance or support services for the App.
  • Apple is not responsible for any warranty claims relating to the App.
  • Apple is not responsible for claims relating to product liability, legal compliance, consumer protection, or intellectual property infringement.
  • Apple and its subsidiaries are third-party beneficiaries of this Agreement and may enforce its terms against you.

17. Google Play Additional Terms

If you downloaded the App through Google Play, your use of the App is also subject to the applicable Google Play Terms of Service.

Nothing in this Agreement limits rights you may have under those terms or applicable law.

18. Changes to this Agreement

Permanent Lighting Experts LLC may update this Agreement from time to time.

Updated versions become effective when posted with a revised Effective Date.

Continued use of the App constitutes acceptance of the updated Agreement.
