These Terms of Use (“Terms”) govern your access to and use of the PLE mobile application (“App”), related websites, software, and services (collectively, the “Services”) provided by Permanent Lighting Experts LLC (“Permanent Lighting Experts,” “PLE,” “we,” “our,” or “us”).
By downloading, installing, accessing, or using the App, you agree to be bound by these Terms. If you do not agree to these Terms, you may not use the App.
1. Eligibility
You must be at least 18 years of age or have the legal authority to enter into this agreement.
By using the App, you represent that you meet these requirements.
2. Purpose of the App
The PLE App provides software tools for customers, dealers, installers, technicians, distributors, and authorized users of Permanent Lighting Experts products and services.
Features may include:
- Lighting system management
- Warranty records
- Installation records
- Scheduling
- Notifications
- Customer communication
- Dealer management
- Installer management
- Product registration
- User account management
- Software updates
- Additional features introduced in future releases
Not every feature is available to every user.
3. User Accounts
Certain features require an account.
You are responsible for:
- Maintaining accurate account information
- Protecting your password
- Keeping your login credentials secure
- All activity occurring under your account
You agree to notify us immediately if you believe your account has been compromised.
4. Sign-In Services
The App may allow authentication using:
- Sign in with Apple
- Google Sign-In
- Email authentication
Your use of these services is also governed by the respective provider’s terms and privacy policies.
5. Acceptable Use
You agree to use the App only for lawful purposes.
You agree not to:
- Violate any law or regulation
- Access accounts that do not belong to you
- Attempt to bypass security measures
- Upload malicious software
- Interfere with App performance
- Reverse engineer the App
- Decompile the App
- Modify the App
- Copy the App
- Sell access to the App
- Use automated systems to access the App without authorization
- Attempt unauthorized access to our servers
Violation of these Terms may result in suspension or termination of your account.
6. User Content
You may upload information including:
- Installation photos
- Warranty photos
- Job documentation
- Customer notes
- Product information
- Profile images
- Other project-related information
You retain ownership of the content you submit.
By submitting content, you grant Permanent Lighting Experts LLC a worldwide, non-exclusive, royalty-free license to store, process, display, and use the content solely for operating, maintaining, improving, and supporting the App and its related services.
You are responsible for ensuring that you have the legal right to upload any content submitted through the App.
7. Dealer and Installer Information
The App may display information submitted by independent dealers, installers, distributors, or other authorized users.
Permanent Lighting Experts LLC is not responsible for:
- Dealer pricing
- Installation workmanship
- Scheduling decisions
- Independent contractor actions
- Customer agreements
- Services provided outside the App
Dealers and installers remain independently responsible for their own businesses and customer relationships.
8. Warranty Information
The App may display warranty information for customer convenience.
The official warranty is governed by the written warranty provided by Permanent Lighting Experts LLC or the applicable authorized dealer.
If a conflict exists between information displayed in the App and an official written warranty, the written warranty controls.
9. Payments
Certain purchases may be processed through Stripe or other authorized payment providers.
Permanent Lighting Experts LLC does not store complete payment card information.
Payment processing is subject to the payment provider’s own terms and policies.
10. Software Updates
We may release updates, bug fixes, enhancements, security improvements, and new features at any time.
Some updates may be required for continued use of certain features.
Failure to install updates may result in reduced functionality or loss of access to portions of the App.
11. Intellectual Property
The App, including but not limited to:
- Software
- Source code
- Design
- Logos
- Branding
- Graphics
- Icons
- User interface
- Documentation
- Text
- Images
- Trademarks
are the exclusive property of Permanent Lighting Experts LLC or its licensors and are protected by applicable intellectual property laws.
No ownership rights are transferred to you.
12. Feedback
If you provide suggestions, ideas, recommendations, feature requests, or other feedback regarding the App, you grant Permanent Lighting Experts LLC the unrestricted right to use that feedback without compensation or obligation.
13. Service Availability
We strive to provide reliable service but do not guarantee uninterrupted access.
The App may occasionally experience:
- Scheduled maintenance
- Unexpected outages
- Software bugs
- Connectivity issues
- Third-party service interruptions
Features may change or be discontinued at any time without prior notice.
14. Suspension and Termination
We reserve the right to suspend or terminate access to the App at any time if we reasonably believe a user has:
- Violated these Terms
- Misused the App
- Attempted unauthorized access
- Compromised system security
- Engaged in fraudulent activity
Termination may occur without prior notice when necessary to protect our users or systems.
15. Disclaimer of Warranties
The App is provided “AS IS” and “AS AVAILABLE.”
To the fullest extent permitted by law, Permanent Lighting Experts LLC disclaims all warranties, whether express or implied, including warranties of:
- Merchantability
- Fitness for a particular purpose
- Non-infringement
- Continuous availability
- Error-free operation
We do not guarantee that the App will always operate without interruption or that defects will be corrected immediately.
16. Limitation of Liability
To the fullest extent permitted by law, Permanent Lighting Experts LLC, its officers, employees, affiliates, licensors, suppliers, and partners shall not be liable for any indirect, incidental, consequential, special, exemplary, or punitive damages arising out of or related to your use of the App.
Our total liability for any claim relating to the App shall not exceed the amount you paid directly to Permanent Lighting Experts LLC for use of the App during the twelve (12) months preceding the event giving rise to the claim.
17. Indemnification
You agree to defend, indemnify, and hold harmless Permanent Lighting Experts LLC and its officers, employees, contractors, affiliates, and licensors from any claims, liabilities, damages, losses, costs, or expenses arising from:
- Your use of the App
- Your violation of these Terms
- Your uploaded content
- Your violation of any applicable law
- Your infringement of another person’s rights
18. Governing Law
These Terms shall be governed by and interpreted under the laws of the State of Utah, without regard to conflict of law principles.
Any legal action arising under these Terms shall be brought exclusively in the state or federal courts located in Utah.
19. Changes to These Terms
We may update these Terms from time to time.
The updated version will become effective when posted on our website with a revised Effective Date.
Your continued use of the App after any changes constitutes acceptance of the revised Terms.
